Terms and Conditions and Privacy Policy

These terms apply to every job we do. Our refunds and returns policy is in section 8 and our privacy policy is in section 14.

Last updated 7 November 2026

1. Who we are and when these terms apply

1.1 These terms apply to every service we provide and every product we sell, however you book. "We", "us" and "our" means Mobile Computer Geeks Pty Ltd ACN 662 494 555 as trustee for its trading trust, ABN 17 319 247 264, trading as Mobile Computer Geeks. "You" means the customer who books or receives our services.

1.2 If you have a separate written agreement with us, such as a managed IT services agreement or a signed quote, that agreement applies first. These terms cover anything it does not.

1.3 By booking, or by letting us start work, you agree to these terms.

1.4 We may update these terms. The version on our website when you book applies to that job. Changes do not apply to work already booked unless you agree.

2. Notice for goods presented for repair

As required by the Australian Consumer Law:

(a) Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

(b) The repair of your goods may result in the loss of data stored on them, such as files, photos, emails and settings. Please back up your data before the repair.

3. Our services

3.1 We provide our services with due care and skill. Our technicians are our employees or contractors we engage, and we are responsible for the work they do for you.

3.2 We confirm what you need before we start. If the job needs more work than you booked, or will cost more than we told you, we will ask you before doing it.

3.3 For remote support, we connect to your device only with your permission and disconnect when the session ends.

3.4 Some repairs must be finished away from your premises. We only take a device with your approval, and we tell you when it is ready.

3.5 Software we install must be properly licensed. You are responsible for licences for software you ask us to install, unless we supply it.

4. Your responsibilities

4.1 Back up your data before our visit or before giving us a device. We take reasonable care with your data, but the notice in clause 2 applies.

4.2 Give us accurate information about the problem, and safe access to the premises, devices and accounts we need for the job.

4.3 You confirm that you own the devices and accounts we work on, or have the owner's permission.

4.4 We may stop work if we reasonably believe it is unsafe for our technician to continue.

5. Prices and payment

5.1 Our prices are on our website or in your quote, and include GST unless we say otherwise.

5.2 Unless we agree other terms in writing, payment is due when the work is complete. Business accounts with credit terms pay by the due date on the invoice.

5.3 We accept cash, debit and credit cards, bank transfer (EFT), and Afterpay and Zip where available. We do not charge payment surcharges.

5.4 If an invoice is unpaid 14 days after its due date, we may charge interest on the overdue amount at 3% a year above the Reserve Bank of Australia cash rate target, calculated daily. We may also recover our reasonable costs of collecting it and pause further work until it is paid.

5.5 Parts and products we supply remain ours until paid for in full. Risk passes to you when they are delivered or installed.

6. No solution, no fee

6.1 If we cannot find a solution to the problem you booked us for, you do not pay for our time on that problem.

6.2 Sometimes the solution is to replace or upgrade hardware or software. If we identify that solution and you choose not to go ahead, our time is still charged, because we found the solution.

7. Our 14-day repair guarantee

7.1 If a fault we fixed comes back within 14 days of the job, we will return or reconnect and fix it at no charge for our labour.

7.2 To claim, call 07 3063 7616 or email support@mobilecomputergeeks.com.au within the 14 days, with your invoice number and a description of the fault. Stop using any part we fitted if it seems faulty.

7.3 We pay our own costs of handling a valid claim. Parts we fitted are also covered by their manufacturer's warranty.

7.4 The guarantee does not cover new faults unrelated to our work, damage after our visit (for example from accidents, liquid, power surges or software installed later), or faults in third-party services such as your internet provider.

7.5 This guarantee is given by Mobile Computer Geeks Pty Ltd ACN 662 494 555 trading as Mobile Computer Geeks, 7/39-41 Ariel Avenue, Kingston QLD 4114, phone 07 3063 7616, email support@mobilecomputergeeks.com.au.

7.6 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Our 14-day repair guarantee is in addition to these rights.

8. Refunds and returns

8.1 We do not give refunds or exchanges if you simply change your mind, unless we agree to.

8.2 If goods we sold have a major problem, you can choose a refund or replacement, or keep them and ask for compensation for the drop in value. A major problem includes goods that are unsafe, significantly different from their description, or have a problem that would have stopped you buying them had you known. If the problem is minor, we will repair, replace or refund within a reasonable time. If we don't, you can choose a refund or replacement.

8.3 If a service has a major failure, you can cancel and get a refund for the unused portion, or compensation for its reduced value. If the failure is minor, we will fix it within a reasonable time. If we don't, you can cancel and get a refund.

8.4 You may also be entitled to compensation for other reasonably foreseeable loss or damage caused by a failure.

8.5 To ask for a remedy, contact us with proof of purchase. This can be a receipt, invoice, bank or card statement, or order number.

8.6 For information about your rights, contact the Office of Fair Trading Queensland on 13 QGOV (13 74 68) at qld.gov.au/fairtrading, or the ACCC on 1300 302 502 at accc.gov.au.

9. Devices left with us

9.1 If we take a device away, we tell you when it is ready to collect or be returned.

9.2 If a device is not collected, we will try to contact you. A device not collected within six months of our notice may be dealt with under the Disposal of Uncollected Goods Act 1967 (Qld). This can include sale at public auction, with our reasonable costs deducted and the balance paid to you or held as that Act requires.

10. Your data and privacy

10.1 We access only the files, accounts and settings needed for the job, and keep what we see confidential.

10.2 We only copy your data when the job needs it, such as data recovery or a backup you asked for, and only keep copies for as long as the job needs.

10.3 How we collect, use, share and protect personal information is explained in our privacy policy in section 14.

11. Liability

11.1 Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law that cannot be excluded.

11.2 If you are a business customer and our goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited, where the law allows, to supplying the services again or paying for them to be supplied again, and for goods, to repairing or replacing them or paying for that.

11.3 As far as the law allows, we are not liable for loss of data, profits or business opportunities, except where the loss is caused by our failure to take due care and skill or to meet a consumer guarantee.

12. Cancelling and ending services

12.1 You can cancel or reschedule a booking by contacting us before the appointment.

12.2 We may stop providing services if an invoice stays unpaid after we have asked you to pay it, or if you seriously breach these terms. We will tell you in writing.

13. General

13.1 These terms are governed by the laws of Queensland. Disputes may be heard by Queensland courts and tribunals, including the Queensland Civil and Administrative Tribunal (QCAT).

13.2 If any part of these terms is invalid or unenforceable, that part is removed and the rest still applies.

13.3 If we don't enforce a right straight away, we can still enforce it later.

13.4 We may send notices to the email address or phone number you gave us.

14. Privacy policy

14.1 This privacy policy explains how Mobile Computer Geeks handles personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. It applies to our website, our online booking system and the services we provide.

14.2 We collect names, phone numbers, email addresses, the address where we provide a service, business details, details about your devices and the problem, booking and job history, invoices and payment records, messages and call notes, and reviews or feedback you give us. If you are a business client, we may also hold details of your staff and the systems we support.

14.3 When we work on a device or account, we may see personal information stored on it. We only access what the job needs and keep it confidential.

14.4 We collect personal information directly from you when you book online, fill in a form on our website, call, email or message us, or when our technicians visit. We may also receive it from your employer if we support your workplace, from a business that refers you to us, and automatically when you use our website (see clause 14.11).

14.5 We use personal information to provide and manage our services and bookings, contact you about your job, issue invoices and take payments, handle guarantee and warranty claims, provide support, improve our services, send service updates and offers, meet our legal obligations, and protect our systems and customers.

14.6 You can make a general enquiry without giving your name, or using a pseudonym. To book a job, we need your name, contact details and the address where the service will be provided.

14.7 We share personal information only as needed with our employees and the contractors who perform our services; service providers that help us run the business, such as booking, customer management, accounting, payment, email, phone, messaging, hosting and backup providers; manufacturers, suppliers and telecommunications providers when needed for a warranty claim or a service you order, such as an NBN connection; our professional advisers; and government agencies or others where the law requires or allows it. We do not sell personal information.

14.8 Some of our service providers store or process personal information outside Australia, including in the United States. We take reasonable steps to make sure they protect it in line with the Australian Privacy Principles.

14.9 We may send you service updates and offers by email or SMS. Every message includes a way to opt out, or you can contact us to stop them. We comply with the Spam Act 2003 (Cth).

14.10 We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, and limit access to the people who need it. We keep personal information only as long as we need it for the purposes above or as the law requires (for example, tax records are generally kept for five years), then securely destroy or de-identify it.

14.11 Our website uses cookies and similar technologies. We use Google Analytics and Google Tag Manager to understand how the website is used, Google advertising tags to measure our ads, Google reCAPTCHA to protect our forms from spam, and a widget that shows our Google reviews. These services may collect information such as your IP address, browser type and the pages you visit, and Google may process it outside Australia. You can block or delete cookies in your browser settings, and opt out of Google Analytics with Google's opt-out browser add-on.

14.12 We do not use computer programs to make decisions about you that could reasonably be expected to significantly affect your rights or interests.

14.13 You can ask for access to the personal information we hold about you, or ask us to correct it. We respond within 30 days and do not charge for this. If we refuse a request, we will tell you why in writing and how to complain.

14.14 If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.

14.15 If you have a privacy question or complaint, contact us on 07 3063 7616 or support@mobilecomputergeeks.com.au. We will respond within 30 days. If you are not satisfied with our response, you can contact the OAIC on 1300 363 992 or at oaic.gov.au.

14.16 We may update this privacy policy. The current version is always on this page, with the date it was last updated.
